Statute Barred !!
I had a loan over 8 years ago, the last contact i had with them was 2004. I started to recieve letters from Aktiv Capital 2006/7, I have ignored them constantlyand eventually they all but stopped. Then last year they have bombarded me with letters, past info to other parasites and even had a doorstep collector call in June 2011. I have not got into any conversation with any of them and not paid a penny since 2004. After the collector called I asked a debt advice company for help, I was told that this loan is in 'Probate' and they wrote to them and Everything went quiet again. Now Rossendales have got involved and because I would not open up a security check with them they are threatening further action.

Thanks for your question. From the information you have given, it sounds as though your debt may be “Statute Barred”, rather than “probate”. Statute Barred means that if your debt is 6 years old or more and you haven’t been chased for it or had any contact regarding it, then you may not have to pay for it.
We would need further information from you in order to determine whether the debt is statue barred, for example if you’ve acknowledged the debt in any way, it won’t be.
