  • Hello Yvonne,

Your confusion is completely understandable, claims can be complex and there’s a lot at stake so taking the time to ask a question is a sensible move. Firstly, banks and other creditors frequently make direct offers of settlement to customers, even though they have chosen to use an agent or claims management firm to act on their behalf, so this isn’t unusual. It may be that they’ve sent the offer to the agent acting on your behalf as well, as this is frequently, and usually the case.

You are well within your rights to accept the offer, however, I would always advise you to speak with the agent you’ve paid to undertake the claim first. They may be able to offer additional advice to you, and as you’ve signed a contract with them, it would be sensible to make sure that you accept the offer under any terms within that contract. Therefore, give your agent a call, inform them of the offer and that you would like to accept and they will advise as to the exact process to follow.

Just one final point, you mention within your query that you’ve paid an upfront fee for this service, I’d like to make you aware that the Ministry of Justice who regulate claims companies, usually oppose companies charging up front fees for claims of this kind. There may be circumstances which justify this as a genuine part of their service but I feel it important that we make you aware of this so you can query the method of sale if you feel appropriate.

I hope this helps but if you would like any additional advice or support please don’t hesitate to get in touch.
