no contact from debt collectors, then suddenly given me 2 days to pay otherwise court, is this right?what are my rights?

i owed santander cards for a store card i used to have with GE money.
i spoke to santander many a little over a month ago asking about how much i owed so i coulld sort out paying them to which they replied that my account has now been referred to the lewis group. I rang them up about twice a week for 5 weeks to see if my account had finished being transferred and spoke to them yesterday and they have told me they've started proceedings to get a county court judgement against me unless i pay them £270 for the next 3 months..when i asked to pay it in smaller amount as im only on sick pay and only get ssp at the moment, she said it was non-negotiable.I spoke to them on the wednesday 21st and they've given me till the 23rd friday to to make a payment to stop it.

ANY HELP would be appreciated...thanks

  • Hi Lee,

I’ve spoken to the debt management team here and they have given me the following information:

Firstly, there should be notes on your file with Lewis Group to confirm that you have been in contact with them – this is important because it shows that you have made attempts to get in touch and that you have the intention to pay the debt back. Have you received anything in writing from the Lewis Group or GE, to confirm your account was being transferred over? If they have written to you and you have not responded then they could have a case to put a CCJ in place.

If they have started proceedings and a CCJ is put in place, any proof/records of the phone calls you made to them (such as dates, time and the names of people you spoke to) will stand in your favour and could help you dispute the CCJ. If you are unable to dispute the CCJ and it is enforced you can submit an offer to the courts of a reasonable amount you can afford to pay based on your income and expenditure.

    I hope this helps
