I have a debt management plan and have now received a county court judgement, I need help!

I have been in adept mangment plan now for 1 year and have been hit with a count court judment. The amount that they are wanting me to pay takes all my dispobible income and leaves me with 2 pound a month. How can they do this?

Will i be able to add this to my debt managment plan?

Also i am paying 50 pounds a month for my plan and now find out that we can get them for free! how can Bains and enst do this?

  • Hi Mark,

    Thanks for your question. Based upon the information you’ve given us there are a few different scenarios.

    You haven’t mentioned whether the CCJ is for a debt which is already included on your DMP, if it isn’t included then the following will apply:
    If the CCJ is for a consumer-based debt, for example a credit card, loan or storecard then this can be added into your DMP. You debt management company can apply to the court for a variation on the judgement that has been set by completing an N245 form on your behalf.

    If the CCJ is for a debt which is in relation to a non consumer credit related matter, for example parking fines, bailiffs for council tax etc then this cannot be added into your DMP and you will need to liaise directly with the courts to deal with this.

    If the CCJ is for a debt that is already included on your DMP then you will need to contact Baines & Ernst who will, as above, be able to apply to the Court to vary the order set by the CCJ

    With regards to Baines and Ernst charging a fee, there has been some debate within the industry regarding fee-paying debt solutions compared to the free advice which is provided by organisations such as the Citizens Advice Bureau.
