  • We have advised our clients the following:

    If the tax demanded relates to a claim by HMRC which pre-dates your creditors meeting:

    then it will be caught as a debt within the IVA and will not separately have to be re-paid. Please contact your supervisor as soon as possible so they can act on this information as soon as you receive it.

    If the tax demanded relates to a claim by HMRC which post-dates your creditors meeting

    Speak to your Supervisor and ask if they can provide you with a letter to send back to HMRC appealing their request and confirming your current IVA and the implications this additional repayment may have on your IVA. The letter should also ask HMRC to re-consider their decision to claw back the tax based on your individual circumstances.

    If HMRC still insist you must make the repayments over a 12 month period (but only in the second scenario above), contact your Supervisor to explain how this could affect your ability to meet your current IVA payments. For ClearDebt clients in this situation we will work closely with them to create a variation request to creditors for the IVA, which we will put together and submit on their behalf asking them to reduce IVA payments until the debt to HMRC is repaid.
