my lodger has debts, can bailiffs take my possessions?

I have a lodger who owes money to a bank and there asking for the money that he spent on a credit card the bill was from 8 years ago. What hapens to my stuff thats in the property when the bailifs come round as he's not being making payment towards it.

  • Bailiffs can only take goods belonging to the person they are chasing for money or people who are named on the liability order. This means that if the debt is just in your lodger’s name, the bailiff should not take goods which are owned by you or even anything which you own jointly with your lodger. If bailiffs attempt to take goods that belong to you, explain that the goods do not belong to your lodger. If you can, show a receipt or note as proof that you own the goods. You may have to provide a sworn statement in the form of a "statutory declaration" to say this is the case.
    It’s also worth noting that bailiffs cannot take goods which are rented or hired by your lodger. This includes goods on hire purchase agreements. If they attempt to take something which your lodger has on a hire agreement, your lodger should show them a copy of his credit agreement.

  • As Laura has already said, if you can show that the items in your property belong to you then bailiffs will not be allowed to take them. I would also recommend you have some proof of him being a lodger, such as a rent book or tenancy agreement. Is your lodger’s debt subject to a CCJ? If not, then it’s unlikely bailiffs will come to your property.
