Communication breakdown

Why is is that I was told that I did not have difficult creditors and on the day of my meeting never had one vote and then to be told that none of my creditors vote except only one. Which you had to send the paper work too. I called the office twice then to say two people never received any paper work. I had to chace up to see if I had any votes and still not heard if one person came back with a vote a day later. If they knew that possibly my creditors would not vote what is the point of an IVA.

    We have identified your case within the Pre Appointment Department and I can advise as follows:

    I am unsure why you would have been told that you did not have difficult creditors, nor who would have told you this? Every creditor is different and every IVA Proposal is reviewed distinctly from the others due to everyone’s circumstances being different. Therefore if a creditor was to accept your IVA, there is no guarantee that they will accept the next one that lands on their desk.

    You have 5 creditors, Provident, JD Williams and 3 x Payday Loans. From your mix of creditors, I do believe that getting your IVA approved is not as straight forward as others. The reasons for this is from our experience, Provident do not vote on IVAs and Payday loans tend to reject them, we are therefore speaking with JD Williams.

    Your Personal Insolvency Advisor, Anna Pitts has spoken with JD Williams and they have advised her that they have not received notice of the IVA, therefore they have requested for Anna to email over a copy and they will review this and submit a vote as soon as possible. This was sent over yesterday and I believe Anna informed you of this? I have checked the system and can confirm that the documents were sent to the correct addresses.

    Anna has chased JD Williams today and will update you as soon as she has further news.

    ClearDebt takes high standards of client service very seriously and every case we deal with really is different.

    People who choose IVAs work hard to repay as much as they can afford. Yes, an IVA eliminates unaffordable debt but it does represent a fair deal for debtor and creditor alike. Pay Day loan companies may feel hard done by (as they are often used as a person's last throw of the dice) but they've no real reason to, with the interest rates they charge. When someone takes the decision to take responsibility for their debt and to work to repay what they can afford, in an IVA, they should support it.
